AFFIDAVIT DISCLOSING A DEFENCE ON THE MERIT

I, ChukwuKanayo, Male, Adult, Christian and a Nigerian Citizen of No. 10 Breeze Street Wuse Zone 2 Abuja do hereby make oath and state as follows:

1. That I am the Managing Director of the Defendant and by virtue of which I am conversant with the facts of this case.
2. I have the authority and consent of the defendant to depose to this affidavit.
3. That it is true that the Plaintiff and defendant entered into a contract on then 15 day of March 2000 for the supply of 5, 000 tons of cashew nuts worth N10,000,000.00 only.
4. The cashew nuts supplied by the Plaintiff were substandard, not been fit for its purpose and a breach of contract.
5. That the defendant as a result has refused to pay the contract sum to the Plaintiff.
6. That the defendant has a good defence to the Plaintiff’s claims.
7. I make this statement in good faith believing its content to be true and correct in accordance with the Oaths Act.
